1. Acceptance of Terms

By accessing or using the MAXIFITM services, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use our services.

2. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of any material changes through our website or by sending you an email. Your continued use of our services after such modifications constitutes your acceptance of the updated terms.

3. Membership and Services

MAXIFITM offers various membership options and fitness services, including EMS training. By purchasing a membership or service, you agree to the following:

• You will provide accurate and complete information during the registration process and keep this information updated.
• Membership fees are charged according to the rate for your selected membership plan and are non-refundable except as required by law.
• Memberships may be subject to minimum commitment periods as specified at the time of purchase.
• You must be at least 18 years old to use our EMS training services.

4. Health and Safety

Your health and safety are important to us. By using our services, you acknowledge and agree to the following:

• You have consulted with a healthcare professional before beginning any exercise program, including EMS training.
• You will disclose any medical conditions, injuries, or health concerns to our staff before participating in any fitness activities.
• EMS training may not be suitable for everyone. Specific contraindications include but are not limited to: pregnancy, pacemaker or other electronic implants, epilepsy, severe cardiovascular conditions, and certain types of cancer.
• You will follow all safety instructions provided by our staff and use the equipment properly as directed.
• You assume all risks associated with participation in physical activities at our facilities or using our services.

5. Cancellation and Rescheduling

Our cancellation and rescheduling policy is as follows:

• Sessions must be cancelled or rescheduled at least 24 hours in advance to avoid being charged for the session.
• Late cancellations or no-shows will result in forfeiture of the session.
• MAXIFITM reserves the right to cancel or reschedule sessions due to unavoidable circumstances, in which case you will receive a full credit or refund for the affected session.

6. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

7. User Conduct

When using our services, you agree not to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others, including privacy and intellectual property rights.
• Use our services for any illegal or unauthorized purpose.
• Interfere with or disrupt the services or servers or networks connected to the services, or disobey any requirements, procedures, policies, or regulations of networks connected to the services.
• Harass, abuse, or harm another person, including our staff, trainers, or other clients.

8. Intellectual Property

All content on our website and mobile application, including text, graphics, logos, images, and software, is the property of MAXIFITM and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from this content without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, MAXIFITM and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our services.

10. Indemnification

You agree to indemnify, defend, and hold harmless MAXIFITM and its affiliates, officers, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms of Service.

11. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service. Upon termination, your right to use our services will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of North Macedonia, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Skopje, North Macedonia.
